Terms and Conditions

The Site is operated by Casa Marea Sunzal (the “Operator”), with domicile at Cerromar, El Sunzal, Department of La Libertad, El Salvador. Notices relating to these Terms may be sent to privacidad@casamareasunzal.com. The designated channel for notices is electronic mail.

Use of the Site constitutes acceptance of these Terms and of the Privacy Notice and Cookie Policy published on the Site. If you do not agree, you must refrain from using the Site and from initiating any booking.

Where a stay is contracted through a third-party platform or a direct-booking channel, the contract of lodging shall also be subject to the specific terms of that channel, which shall prevail in the event of conflict solely as regards price, cancellation, house rules, and check-in and check-out times.

The Site and the lodging are intended exclusively for persons of legal age. The compound is not designed or certified as child-proof (terraces with railings, balconies, stairs, and shared common areas). Minors are not accepted as guests.

You represent that you have full legal capacity to bind yourself under the laws of El Salvador. If you access the Site on behalf of another person, you represent that you are duly authorized to do so.

The Operator offers lodging in apartments and studios for adult guests. Descriptions, photographs, videos, floor plans, and other materials published on the Site are indicative and intended to present the units and the compound in good faith. They do not constitute a contractual offer until a booking is confirmed through an official channel.

Availability, rates, taxes, deposits, cancellation policies, and house rules are those in force on the platform or instrument through which the booking is completed. The Operator does not guarantee availability merely by reason of information displayed on the Site.

Online booking links may be published, modified, or temporarily withdrawn. While no booking channel is displayed, the Site serves an informational purpose. Once channels are enabled, payment shall be processed by the corresponding platform or under the applicable lodging agreement.

A booking is confirmed only when the selected channel issues the corresponding confirmation. The Operator is not obliged to honor parallel requests made solely through messaging, social networks, or informal channels.

Guests shall respect building rules, the rest of other occupants, and applicable law. Unauthorized commercial use of the premises — including filming, events, or gatherings of a commercial nature — is prohibited without the Operator’s prior written consent.

The Operator may refuse or terminate a stay in the event of material breach of house rules, conduct that endangers persons or property, or use of the lodging for unlawful purposes, without prejudice to any claim for damages.

Surf, swimming, road travel, weather, and outdoor activities involve inherent risks. Each person participates at their own risk and must act with due care. The Operator does not supervise third-party activities (surf schools, restaurants, transport, or excursions) recommended on the Site.

Texts, photographs, video, trademarks, logotypes, graphic design, and the selection and arrangement of content on the Site are protected by intellectual-property and unfair-competition laws. Reproduction, distribution, public communication, or transformation without prior written authorization is forbidden, except for personal, non-commercial viewing of the Site.

You undertake not to use the Site in a manner that damages, overloads, or interferes with its operation or with other users; not to attempt unauthorized access to systems or data; and not to introduce malware or automated means of extraction that impair the service.

The Operator may suspend or restrict access in the event of misuse, security risk, or legal obligation, without prior notice where reasonably necessary.

The Site may contain links to maps, social networks, analytics providers, or booking platforms. Those services are governed by their own terms and privacy policies. The Operator does not control them and assumes no liability for their content, availability, or practices, except to the extent required by applicable data-protection law regarding processors engaged by the Operator.

The Site is provided on an “as is” and “as available” basis. The Operator shall use reasonable care in publishing information, but does not warrant uninterrupted operation, absence of errors, or fitness for a particular purpose beyond what mandatory law requires.

To the fullest extent permitted by Salvadoran law, the Operator shall not be liable for indirect, incidental, or consequential damages arising from use of the Site or from decisions taken on the basis of its content. This limitation does not exclude liability that cannot be waived by law, including that arising from willful misconduct or gross negligence.

The processing of personal data is governed by the Privacy Notice and the Cookie Policy, issued in accordance with the Personal Data Protection Law of El Salvador (Legislative Decree No. 144). Those instruments form an integral part of these Terms.

The Operator may amend these Terms. The version in force is the one published on this page, identified by the date of last update. Continued use of the Site after publication constitutes acceptance of the amended Terms. Material changes affecting an existing contractual relationship shall be communicated by appropriate means where the law so requires.

If any provision is held invalid or unenforceable, the remaining provisions shall continue in full force. Failure by the Operator to enforce a provision shall not constitute a waiver of that provision or of any other right.

These Terms are governed by the laws of the Republic of El Salvador. Disputes arising from the use of the Site shall be submitted to the competent courts of El Salvador, without prejudice to the forum or procedure stipulated in a specific lodging contract, or to rights that cannot be waived by consumers under mandatory law.
